French antiracist legislation: Basis for structural racism

This article recounts the legal career of the racist motive within French antiracist legislation between the 1970s and 2000. By shedding light on the debates which discussed the racist motive, it questions the way the antiracist legislation, by being blind to the race yet produced in other fields of public action, itself participates in structural racism and in the emergence of a second violence within the judicial arena.
