Penalizing the violations of human rights?

The aim of this paper is to highlight the increasing use of criminal justice as a tool, at the national legislation’s level — in France — and at the international one, to protect Human rights. We shall try to account for the reasons of this phenomenon, what it tells about the changing and differential sensitivity to fundamental rights — without omitting, in conclusion, to question its limitations and its negative effects.
