The right to be forgotten: A new fundamental right for the individual?

Legislations protecting individuals’ right to privacy have been gradually passed in the 20th century. Since the 1970s, the notion of “privacy” has more and more blended with the notion of “personal data protection”. The latter has been introduced in European law (directive 95/49/CE in 1995, GDPR in 2016). Applied to the field of information technology and liberties, the question of the legal protection of privacy is tinged with a new claim, the right to be forgotten, which may conflict with freedom of expression or freedom to write history.
